Privacy Policy

1. Who we are

PRAXTON Inc, trading as Nexus Onboard ("we," "us"), provides a workforce onboarding, scheduling and compliance management platform (the "Service") for staffing agencies and their client companies at onboardnx.com.

If your employer or staffing agency uses the Service to manage your employment or engagement, they are responsible for your personal information, and we process it on their behalf. If you are one of our own account administrators, or you contact us directly (for example, for support), we are responsible for that information.

2. Information we collect

Depending on how a client company configures the Service, we may collect:

• Identity and contact information

• Government and tax identification information

• Financial information (for payroll purposes)

• Employment and work-eligibility information

• Background check information

• Emergency contact and reference information

• Sensitive personal information (such as health information), only where required for a specific purpose and with appropriate consent

• Documents uploaded to the Service

• Information about how the Service is used (such as login activity)

3. How we collect it

We collect this information directly from users of the Service, from the client company that engages you, and automatically through use of the Service.

4. How we use it

We use personal information to provide the Service, including onboarding, payroll and billing, scheduling, compliance recordkeeping, performance management, internal communications, and to secure the Service and prevent fraud.

We do not use personal information for advertising or profiling, and we do not sell or share personal information with third parties for cross-context behavioral advertising.

5. How we share it

We share personal information with:

• The client company responsible for your employment or engagement

• Service providers who help us operate the Service (for example, hosting and infrastructure providers), under contracts that restrict their use of the information to providing services to us

We do not sell or share personal information with any other third party.

6. Data Privacy Framework

PRAXTON Inc, trading as Nexus Onboard, complies with the EU-U.S. Data Privacy Framework (DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF as set forth by the U.S. Department of Commerce. We have certified to the Department of Commerce that we adhere to the DPF Principles with respect to personal information received from the European Union, the United Kingdom (and Gibraltar), and Switzerland in reliance on the DPF. If there is any conflict between the terms in this policy and the DPF Principles, the DPF Principles govern. We are subject to the investigatory and enforcement authority of the U.S. Federal Trade Commission with respect to our compliance with the DPF. In certain circumstances, we may be liable for the onward transfer of personal information to third parties under the DPF Principles. If you have an unresolved DPF-related complaint that we have not addressed satisfactorily, you may raise it with the independent dispute resolution provider identified through the Data Privacy Framework website, at no cost to you. Under certain conditions, you may also invoke binding arbitration for residual claims not resolved by other means, as described in Annex I of the DPF Principles.

7. Retention

We retain personal information for as long as needed to provide the Service and to meet legal and contractual obligations, after which it is deleted or de-identified in accordance with our data retention practices.

8. Your privacy rights

Depending on where you live, applicable law may give you rights to know/access, correct, delete, or obtain a copy of your personal information, and to limit certain uses of sensitive personal information. We do not sell or share personal information, so opt-out rights related to sale/sharing are not applicable to our processing.

If your employer or staffing agency is responsible for your information, please direct requests to them; we will assist them in responding. If we are directly responsible for your information, contact us using the details below. We will respond within the time required by applicable law.

We will not discriminate against you for exercising your privacy rights.

9. Security

We maintain reasonable technical and organizational safeguards designed to protect personal information against unauthorized access, use, or disclosure.

10. Cookies

We use only cookies necessary for the Service to function. We do not use advertising or analytics cookies.

11. Children

The Service is a business tool used by employers and staffing agencies to manage their workforce. It is not directed to children, and we do not knowingly collect personal information directly from children for our own purposes. Some client companies lawfully employ workers under the age of 18 (for example, in accordance with applicable minor labor laws), and may use the Service to manage those workers' employment information. Where a client company submits information about an employee under 18, the client company is responsible for ensuring it has the appropriate legal basis and any required parental or guardian consent for that processing; we process the information on their instructions in the same manner as other employee data. If you believe a child's personal information has been submitted to the Service outside of a lawful employment context, please contact us using the details in Section 14 and we will address it.

12. Changes

We may update this policy from time to time. Material changes will be communicated to registered users before they take effect.

13. Notice for UK and European users

If you are located in the United Kingdom or the European Economic Area, the UK GDPR and/or EU GDPR may also apply to our processing of your personal information, in addition to Section 8 above. Legal basis. We process your personal information on the bases of contract, legal obligation, consent (for sensitive information), and our or our client's legitimate interests, as applicable to the purpose. Your rights. You may have additional rights under UK/EU GDPR, including rectification, restriction of processing, data portability, and objection to processing based on legitimate interests, alongside the rights described in Section 8. International transfers. Where we transfer your personal information from the UK or EEA to the United States, we rely on our certification under the EU-U.S. Data Privacy Framework, the UK Extension to the EU-U.S. DPF, and/or the Swiss-U.S. DPF, described in Section 6. Supervisory authority. You have the right to lodge a complaint with your local data protection authority, or with the UK Information Commissioner's Office (ico.org.uk) if you are in the UK. Requests and questions from UK/EU users can be directed to the contact in Section 14.
